Real Estate Tax Breaks for Your Home

It is always beneficial during tax season to own real estate, which gives you many annual deductions. If you purchased residential real estate during this year, however, you can look forward to even more generous savings at tax time.

Mortgage Interest

Though there are several real estate deductions you will be able to take this tax year, the largest is the interest you paid on your mortgage. According to Kiplingers (August 31, 2006), you may write off up to $1 million in mortgage interest for your primary or secondary home (does not apply to third home real estate, unless it is a business or rental property). This can be an enormous tax savings, especially within the first years of ownership with most of your monthly payments going to interest.

Property Taxes

Each year, you may deduct the property taxes you paid. If you recently purchased your home real estate, you also may deduct any taxes the seller paid in advance that were applied to your property tax debt. This applies even if you did not reimburse the seller for these real estate taxes.

Points Paid for Mortgage

Even if the seller paid your points, you may deduct them on your tax return within the year of purchase of the real estate. Each point is worth one percent of the real estate mortgage. For a loan principal of $250,000, you may deduct $2,500 for each point. For a loan face value of $500,000, you may deduct $5,000 per point.

If you refinanced your real estate, you also may deduct these points paid. However, the deduction must be spread over the life of the loan. If you sell the real estate or pay off the loan early, then the remaining deduction may be taken within the year of sale or loan payoff.

Home Equity Debt

You are allowed to deduct up to $100,000 of home equity debt each year, regardless for what you used the money. This makes home equity loans low-interest alternatives for purchasing cars, paying student tuition, underwriting your dream vacation, and so on.

Home Business Use Deductions

If you run a business out of your home or use the real estate for business purposes, such as rental property, you have many deductions for the use of this space. For home offices, the percentage of space you actually use may incur the same percentage in deductions for mortgage payments, utilities and home insurance. Improvements made to accommodate the business, such as bringing the real estate up to standard as rental property or installing a private bathroom when renting out a room, may qualify for a deduction against your profits.

Property Damage

If you incurred uninsured real estate damage due to a qualifying disaster (especially within a presidential declared disaster area), you may qualify for a tax deduction. There are limitations, however, and the deduction generally must be taken within the year the disaster occurred.

What You Cannot Deduct

If you recently purchased or sold real estate, you incurred many costs but not all may be deducted from your taxes. Examples of nondeductible expenses are closing costs, major home improvements to attain a higher sales price, title insurance, appraisal and inspection fees, or attorney fees.

The following 1040 EZ instructions are only applicable to the tax year 2006. These instructions do not apply to any other tax year; however the instructions for previous years may be found online.

How To Get A Bigger Charitable Deduction For Your Church Contribution

Any taxpayer, who makes a contribution to church, or qualified charity, is entitled to take a charitable deduction on their income tax return. This is subject to certain limits, but generally if you itemize deductions on your tax return you get the deduction.
Before arriving at the tax deductible amount, you must make a careful examination of the question what is a charitable deduction?

A contribution in cash or check would qualify and this is generally known. There are some other things not so obvious that are also deductible. If you contribute merchandise or other stuff this is also a deduction. For instance if you contribute a table and chairs to church, the fair market value would be a charitable contribution. The value of a turkey you donate to the thanksgiving dinner would also be a deduction. A contribution in kind is a tax deductible charitable contribution.
Mileage is another church contribution many church members make. The IRS allows 14 per mile driven as an allowable charitable deduction. You must however keep a written record. Generally marking your calendar and noting the trips made for church business is an acceptable method. You must be driving; you do not get a mileage deduction for being a passenger.
When is mileage allowed as a deduction?

Driving to church for a worship service is not a deduction this is considered a personal expense and does not benefit the organization.
Members who drive to church for a work Saturday most certainly qualify for the charitable mileage deduction. Church council or committee members driving to church for meetings would also qualify to deduct mileage. Generally anytime you drive to church and work for the organization, the mileage would be considered a charitable contribution.
Miles driven that benefit a specific individual are not a contribution to the church. Therefore picking up someone and driving them to church is not deductible as mileage.

The dividing line on what is deductible can get a little fuzzy out on the edges. The communion assistant and organist on Sundays when they are performing services have deductible mileage. Sunday school teachers probably can deduct mileage; ushers probably cannot because the work content of their duties at church is outweighed by the personal benefit of their attendance.
A written record of activities should be kept. If they look hard, and keep some records most active church members can usually find more deductions than just the cash and checks they put in the offering plate.

Foreign Bank Accounts, Offshore Bank Accounts, IRS and 5 Year Prison Term

The Tax Code Reads as Follows:

Any United States person who has a financial interest in or signature authority, or other authority over any financial account(s) in a foreign country is required to file a Report of Foreign Bank and Financial Accounts (FBAR), if the aggregate value of these accounts exceeds $10,000 at any time during the calendar year.

A potential nightmare all begins with Line 7 of Schedule B.

Line 7 of Schedule B directly ask a taxpayer if he/she have a foreign bank account. It then tells you the filing requirements for Form TD F 90-22.1. The next question ask if Yes enter the name of the foreign country.

Line 7 of Schedule B is at the bottom of the page, most Americans and a lot of Tax professionals just breeze right past it and continue with the return.

RED FLAG: Failure to file a TD-90-22.1 is a FELONY, punishable by a 5 year prison term.

If you are unsure of how to handle Line 7 of Schedule B, continue to read this article and then contact a Tax professional as soon as possible.

No extensions are allowed for this form. Taxpayers who have earned interest in Canada must comply as well.

There are ways for IRS to find out if you have an offshore bank account or have a financial interest in a foreign account.

One way for IRS to find out, is if you spend more then you report as income. Often times people do this by using a credit card associated with an offshore account or a foreign account.

Another way for IRS to find out is: IRS pays informers to report tax cheaters. Informers can use Form 211 to report tax evasion and receive 8% of the first $100,000 IRS collects from the tax cheater. Of course IRS investigates the informer as well.

Keep in mind that Line 8 of Schedule B has consequences as well. If you have a foreign Trust, you are required to complete Form 3520.

It is highly recommended that if you must complete Line 7 or 8, of Schedule B, that you contact a Tax Attorney or an Enrolled Agent.

IRS Extends Tax Deadlines for Katrina Victims

Following Katrina, the IRS acted quickly to relieve victims of any tax burdens. One step was to extend any tax filing dates to late October and now those dates have been extended again.

Emergency Tax Relief Act

On September 23, 2005, President Bush signed the Katrina Emergency Tax Relief Act of 2005 into law with massive bipartisan support. The Act contains numerous provisions with one of the most important being the extension of tax filing deadlines. Specifically, victims of Hurricane Katrina have been granted an automatic extension until February 28, 2006. The extension covers the filing of taxes, paying of taxes and other related tax items

To benefit from the Tax Relief Act, hurricane victims need to take the following steps. For victims located in areas designated as individual assistance areas by FEMA (Federal Emergency Management Agency) the tax relief is automatic and no action is required to be taken. Of course, you need to make sure FEMA has actually gotten around to visiting your area.

If FEMA has designated your area a public assistance area, you are actually going to have to contact the IRS to claim relief under the Act. To do this, you must simply write Hurricane Katrina in red ink on the top of any tax filings with the IRS. If youre not sure what to do, you can contact the IRS disaster hotline at 866-562-5227.

Obviously, taxes and the IRS are and should be low priority items for victims of Hurricane Katrina. The IRS, however, should be commended for taking immediate action to grant tax relief instead of staggering around like a drunken sailor as we observed with FEMA.

As a salesperson, it is likely that you spend a certain amount of your day traveling. Whether or not you are a traveling salespeople, there are several deductions you are specifically eligible for. Any costs you incur which you are not reimbursed for are typically tax deductible. However, you should proceed with caution. Consult a professional tax preparation company to be sure you are eligible for each deduction.

Any work related expenses that you are subject to and not reimbursed for are usually eligible. If you are required or choose to continue your education, part of those costs may be able to be deducted. Additionally, any licenses or union fees you are required to maintain can amount to a large deduction. In some cases, if you choose to leave your job and find a new one, you may be able to deduct job search expenses. These expenses related to job hunting are an often surprising and generous deduction.

If you are a traveling salespeople, you are nearly guaranteed additional deductions. You can deduct mileage you incur, and other expenses. If your expenditure is considered ordinary and necessary, it is likely deductible. For instance, an ordinary expense may be a client luncheon you are hosting or installation costs for installing equipment. Necessary expenses are those such as a phone line. It is imperative to remember that deductions can only be counted once, and nowhere else on your tax return. Also important is that none of these salespeople related deductions pertain to family matters such as mileage to yours sons ball game.

If you are a traveling salespeople and unfortunately incur a mishap on the road, the government wont cover these costs. The IRS will not accept deductions from speeding tickets, parking tickets or accidents while on the job. This is not considered a necessary deduction. Additionally, any over-extravagance, such as a limo from the airport to the hotel, can oftentimes be considered non-deductible as it may not be necessary. Your work clothing, unless you are required to wear one specific uniform, is not eligible for deductions. Unnecessary memberships and dues may also be considered nondeductible.

As a salespeople, you are eligible for common business deductions. Travel expenses and other necessary and ordinary expenditures can all count as deductions for your tax return. Before filing your taxes, always be certain that you meet all eligibility requirements for each deduction.

If there is something people enjoy less than preparing their tax returns, it is hard to imagine. If you look to another to do the job, be very careful who you pick.

The internal revenue code is a beast of government inefficiency and confusion. I dare you to pull it up on the web and try to give it a read. I guarantee you will be suicidal by the fifth page or at least trying to pluck your eyes out. Heck, even most IRS employees dont understand it. In a study a few years back, an independent group found IRS employees gave out the wrong tax information to taxpayers 50 percent of the time! Former President Carter even called the code a crime against humanity. Hard to argue with that.

As we close in on April, many people will think about having a go at preparing their own taxes. Some will actually go through with the process. Most, however, will throw their hands in the air and look for someone else to handle the mess. This someone else is the infamous tax preparer.

Most tax preparers are good, honest people. CPAs, in particular, are also schooled in all things tax and can get your return prepared with the minimum of fuss. Unfortunately, non-CPAs can be hit and miss when it comes to providing a quality service. In fact, you really need to know who the person is and whether they are even remotely qualified to do your return. Dont believe me? Well, the indicted school bus driver/tax preparer may change your mind.

Yolanda White is a school bus driver in St. Louis. Well, she was. Apparently looking to make a little extra cash, she started offer tax preparer services on the side. While driving a bus full of kids around prepares you for many things, such as war, it really isnt helpful when it comes to the old 1040 form. Ms. White is finding this out the hard way.

On February 1, 2007, the Department of Justice was successful in obtaining an injunction barring Ms. White from preparing any further returns. She apparently had problems claiming the correct deductions and amounts for the same. The IRS audited 30 of the returns she had prepared out of 337 and found all over them to fraudulently claim deductions that had no business being claimed. Where a deduction could be claimed, she also had a habit of inflating the amount of the deduction well beyond the actual amount that could be claimed by the taxpayer. The IRS is now planning to audit the remaining 307 returns she prepared.

Preparing your taxes is pretty low on the totem pole of fun. That being said, make sure you use someone who is qualified to do it should you go in that direction.
